Terms of Service



PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY BEFORE USING THE APP. BY DOWNLOADING, INSTALLING, OR USING GRINDFUEL, YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE APP.


1. About the App

Grindfuel is an AI-powered calorie and nutrition tracking mobile application developed and operated by Neznaika (“we”, “us”, “our”). The App allows users to log meals, track calorie intake and macronutrients (proteins, fats, carbohydrates), and identify dishes using AI-based photo recognition powered by the Claude model (Anthropic, PBC, USA).

The App is available on iOS and Android platforms.


2. Eligibility and Age Requirements

By using the App, you confirm that:

  • You are at least 13 years of age. For users in the European Economic Area (EEA), the minimum age is 16, unless the applicable national law in your country provides for a lower age (but not lower than 13)
  • If you are between 13 and 18 years of age (or the applicable age of majority in your jurisdiction), you have obtained verifiable consent from a parent or legal guardian who has reviewed and agreed to these Terms on your behalf
  • Your parent or guardian accepts full responsibility for your use of the App, including any purchases made
  • You have the legal capacity to enter into a binding agreement under the laws of your jurisdiction
  • Your use of the App does not violate any applicable laws in your country of residence

We reserve the right to suspend or terminate access if we have reason to believe that a user does not meet these eligibility requirements. If we discover that a child below the minimum age has created an account, we will delete it and all associated data promptly.


3. Account Registration

To access certain features of the App, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration and keep it up to date
  • Keep your account credentials confidential and not share them with any third party
  • Notify us immediately at th17thaiapps@gmail.com if you suspect any unauthorised access to your account
  • Take full responsibility for all activity that occurs under your account

We reserve the right to suspend or delete accounts that contain false or misleading information, or that are used in violation of these Terms.


4. Acceptable Use

You agree to use the App only for lawful, personal, and non-commercial purposes. You must not:

  • Use the App in any way that violates applicable local, national, or international laws or regulations
  • Attempt to gain unauthorised access to any part of the App, its servers, or any connected systems
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App
  • Upload or transmit any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable
  • Use the App to transmit spam, malware, viruses, or any other malicious code
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity
  • Scrape, harvest, or collect data from the App by automated means without our prior written permission
  • Interfere with or disrupt the integrity or performance of the App or its infrastructure
  • Use the App for any commercial purpose, resale, or redistribution without our prior written consent

5. AI-Powered Features — Scope, Limitations, and Your Responsibility

The App uses the Claude AI model, developed by Anthropic, PBC (USA), to provide dish recognition and nutritional analysis based on food photos you submit. By using this feature, you acknowledge and accept the following:

5.1 Accuracy Limitations

  • AI-generated nutritional estimates are approximations based on visual analysis only and may not reflect the actual nutritional content of a specific dish
  • Recognition accuracy depends on image quality, lighting, dish presentation, portion size, and other factors outside our control
  • The AI cannot reliably identify all ingredients, preparation methods, sauces, or hidden components of a dish
  • Results may vary significantly for home-cooked meals, regional dishes, mixed plates, or partially visible food items

5.2 Medical and Allergy Disclaimer

Do not use AI recognition results as the sole basis for managing food allergies, intolerances, or medically prescribed diets. The AI may fail to detect allergens (including but not limited to nuts, gluten, dairy, shellfish, or soy) that are present in a dish. If you have a severe allergy or a medical condition requiring strict dietary control, always verify ingredients independently and consult a healthcare professional.

5.3 Eating Disorder Warning

Calorie tracking features may not be appropriate for individuals with or at risk of eating disorders, including anorexia nervosa, bulimia nervosa, orthorexia, or binge eating disorder. If you or someone you know may be struggling with an eating disorder, we strongly encourage you to seek help from a qualified healthcare professional before using this App. We are not liable for any harm arising from use of the App by individuals with eating disorders.

5.4 No Guarantee of Service Continuity

The AI recognition feature depends on the availability of Anthropic’s API. In the event of an API outage or disruption beyond our control, the feature may be temporarily unavailable. We will make reasonable efforts to restore the service as quickly as possible. Service disruptions do not automatically entitle you to a refund unless required by applicable law.

5.5 Your Consent to Image Transmission

By submitting a food photo for recognition, you consent to that image being transmitted to Anthropic’s servers for processing as described in our Privacy Policy.


6. No Medical Advice

The App and all content, features, and information provided through it are for general informational and wellness purposes only. Nothing in the App constitutes medical advice, diagnosis, or treatment of any kind.

You should always consult a qualified physician, registered dietitian, or other licensed healthcare professional before making changes to your diet, exercise routine, or health-related behaviour — particularly if you have a diagnosed medical condition, are pregnant or breastfeeding, are under 18, or are recovering from an eating disorder.

We expressly disclaim any liability for health outcomes, dietary decisions, or any other consequences arising from your use of or reliance on information provided by the App.


7. Subscriptions, Payments, and Refunds

7.1 General

Grindfuel may offer free and premium (paid) features. All purchases are processed through the Apple App Store or Google Play Store, subject to their respective terms and conditions.

7.2 Billing and Renewal

  • Subscription fees are charged at the beginning of each billing period
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • You may manage or cancel your subscription at any time through your App Store or Google Play account settings
  • We reserve the right to change pricing at any time; price changes will be communicated at least 30 days in advance and will take effect at your next renewal

7.3 Refunds

All purchases are generally non-refundable, subject to the following exceptions:

  • EU / EEA consumers: You have a statutory right of withdrawal from a digital purchase within 14 days of the transaction under applicable EU consumer protection law, unless you have already begun using the paid feature, in which case the right of withdrawal may be limited. Refund requests must be submitted through the Apple App Store or Google Play Store in accordance with their refund policies
  • Australia: Consumers have rights under the Australian Consumer Law. If the App fails to meet a consumer guarantee, you may be entitled to a remedy
  • Other jurisdictions: Where local consumer protection law grants you a right to a refund that cannot be excluded by contract, we will honour that right
  • Refund requests in all cases should be directed to the App Store or Google Play Store where the purchase was made

7.4 Service Disruptions

In the event of a prolonged service outage affecting core paid features (exceeding 72 consecutive hours), we will assess affected users for a proportional subscription credit or extension on a case-by-case basis. This does not apply to outages caused by circumstances outside our control, including third-party API outages (such as Anthropic’s services), force majeure events, or platform-level issues.


8. User Content

You may submit content to the App, including food diary entries, notes, and photos (“User Content”). You retain all ownership rights to your User Content. By submitting User Content, you grant us a limited, non-exclusive, royalty-free licence to store and process that content solely for the purpose of providing the Service to you.

You represent and warrant that:

  • You own or have the necessary rights to submit your User Content
  • Your User Content does not infringe any third-party intellectual property, privacy, or other rights
  • Your User Content does not contain illegal material or violate any applicable laws

We do not use your User Content to train AI models, create advertising profiles, or for any purpose beyond delivering the Service to you.


9. Intellectual Property

All content, design, graphics, logos, software, and other materials in the App (excluding your User Content) are the property of Neznaika or its licensors and are protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App on your personal device solely for personal, non-commercial purposes in accordance with these Terms.

You may not copy, reproduce, modify, distribute, sell, or create derivative works from any part of the App without our prior written permission.


10. Third-Party Services

The App integrates with or may contain links to third-party services, including:

  • Anthropic (Claude AI) — for AI-based dish recognition and nutritional analysis. Governed by Anthropic’s Terms of Service and Privacy Policy at anthropic.com
  • Apple App Store / Google Play Store — for app distribution and in-app purchases
  • Analytics and crash reporting providers

We are not responsible for the content, privacy practices, accuracy, or availability of any third-party services. Your use of third-party services is governed by their respective terms and privacy policies.


11. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, error-free, or available at any particular time
  • AI-generated nutritional estimates or dish recognition results will be accurate, complete, or suitable for your specific needs, dietary requirements, or medical conditions
  • The App will be free of viruses or other harmful components
  • Any errors or defects in the App will be corrected

Nothing in this section limits any rights you may have under applicable mandatory consumer protection law in your jurisdiction.


12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEZNAIKA AND ITS OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO:

  • Inaccurate nutritional or calorie information generated by the AI
  • Failure to detect allergens or ingredients in a photographed dish
  • Health outcomes or medical decisions made in reliance on App content
  • Harm arising from use of the App by individuals with eating disorders or other health conditions
  • Loss of data, loss of profits, or service interruptions

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE APP EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD 50, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law. Nothing in this section excludes or limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.


13. Indemnification

You agree to defend, indemnify, and hold harmless Neznaika and its officers, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use or misuse of the App
  • Your User Content
  • Your violation of these Terms
  • Your violation of any applicable law or the rights of any third party
  • Any health-related decisions or outcomes resulting from your use of the App

14. Termination

We may suspend or terminate your access to the App at any time, with or without notice, if we have reason to believe you have violated these Terms, applicable law, or if required for security or operational reasons.

You may stop using the App and request deletion of your account at any time by contacting us at th17thaiapps@gmail.com. We will process account deletion requests within 30 days and permanently delete your personal data in accordance with our Privacy Policy.

Upon termination, your right to use the App ceases immediately. Sections 9, 11, 12, 13, and 15 shall survive termination.


15. Governing Law, Disputes, and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the United Arab Emirates.

In the event of a dispute arising out of or relating to these Terms or the App, the parties agree to first attempt to resolve the matter amicably through good-faith negotiation. If the dispute cannot be resolved within 30 days of written notice, it shall be submitted to the exclusive jurisdiction of the competent courts of the United Arab Emirates.

Note for users outside the UAE: If you are a consumer in the EU, EEA, United Kingdom, or Australia, mandatory consumer protection laws in your jurisdiction may entitle you to bring a claim in your local courts or before a local dispute resolution body, regardless of this clause. This Terms does not limit any such mandatory rights.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.


16. Changes to These Terms

We reserve the right to update or modify these Terms at any time. We will notify you of significant changes via the App or by email at least 14 days before the changes take effect.

Your continued use of the App after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the updated Terms, you must stop using the App. You may request deletion of your account at any time.
